LUXE X SUN

                                     IMPORTANT: PLEASE READ CAREFULLY BEFORE BOOKING AN APPOINTMENT

                    This Liability Waiver and Release of Claims ("Waiver") is a legally binding agreement between the undersigned customer ("Client") and Luxe X Sun ("Company"), effective as of the date of booking a picnic with  Luxe X Sun.

                    By booking an appointment with Luxe X Sun, the Client agrees to the following terms and conditions:

                                                                                            1. Assumption of Risk:

                  The Client acknowledges and agrees that participation in a picnic organized, hosted, or facilitated by Luxe X Sun involves inherent risks, including but not limited to personal injury, property damage, accidents, and potential exposure to health hazards. The Client voluntarily assumes full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by the Client or any guest(s) during or after the picnic, whether caused by the negligence of the Company or otherwise.

                                                                                             2. Release of Liability:

                 The Client, on behalf of themselves, their heirs, executors, administrators, assigns, and personal representatives, hereby releases, discharges, and agrees to hold harmless Luxe X Sun, its owners, employees, agents, contractors, and affiliates (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, or liabilities of any kind or nature, whether known or unknown, arising from or related to any accident, injury, illness, or damage that may occur during or after the picnic, including but not limited to claims arising from the negligence of the Released Parties.

                                                                                              3. Indemnification:

                The Client agrees to indemnify and hold harmless Luxe X Sun and the Released Parties from any claims, demands, damages, or expenses (including attorney's fees and legal costs) arising out of or related to the Client's or their guest(s)' participation in the picnic, or any actions or omissions of the Client or their guest(s).

                                                                               4. No Liability for Third-Party Acts:

                Luxe X Sun shall not be responsible for any injury, loss, or damage caused by third parties, including but not limited to other guests, vendors, or participants. The Client acknowledges that any interaction with third parties during the picnic is at their own risk.

                                                                                             5. Waiver of Claims: 

                By booking an appointment, the Client acknowledges that they waive their right to bring any legal action against Luxe X Sun for any claims, damages, or injuries arising from the picnic. This waiver extends to any claims based on negligence, breach of contract, or breach of warranty by the Released Parties.

                                                                                            6. Health and Safety:

                The Client certifies that they and their guest(s) are in good health and free from any condition that may affect their ability to participate in the picnic. The Client assumes all responsibility for any health risks associated with the picnic and releases Luxe X Sun from any liability related to health issues that may arise during or after the event.

                                                                                               7. Governing Law:

                 This Waiver shall be governed by and construed in accordance with the laws of the state of Georgia in which Luxe X Sun operates. Any legal actions or disputes arising from this Waiver or the Client's participation in a picnic shall be presented exclusively in the courts of Georgia.

                                                                                             8. Entire Agreement:

                This Waiver constitutes the entire agreement between the Client and Luxe X Sun with respect to liability and supersedes any prior or contemporaneous understandings, whether written or verbal.

             By booking a picnic with Luxe X Sun, you, the Client acknowledges that you have read, understood, and voluntarily agreed to the terms of this Waiver, and you agree to be bound by its terms. Your booking serves as your electronic signature and agreement to the terms of this liability waiver and release of claims form.
